Terms of Service

These Terms of Service ("Terms") govern your access to and use of indielist (the "Service"), operated by indielist ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

indielist is an information directory for the indie game ecosystem: games, studios, publishers, funding, and the relationships between them. We provide facts sourced from public data, editorial content, and white-box sales estimates — modeled figures shown with their assumptions and breakdown, not guarantees of actual sales.

2. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate information and be at least 16 years old (or the age of digital consent in your country). We may suspend or terminate accounts that violate these Terms.

3. Subscriptions and billing

Paid plans (Starter, Pro, and Featured) are billed in advance on a recurring basis through our payment provider. Unless stated otherwise:

  • fees are quoted exclusive of taxes, which we add where required;
  • subscriptions renew automatically until cancelled;
  • you may cancel at any time and will retain access through the end of the current billing period;
  • except where required by law, payments are non-refundable for partial periods.

We may change prices with reasonable notice; changes apply to the next billing cycle.

4. Acceptable use

You agree not to:

  • scrape, crawl, or bulk-extract the Service except as expressly permitted (an API and machine-readable mirrors are provided for sanctioned access);
  • resell, redistribute, or create a competing directory from our compiled data and estimates;
  • attempt to disrupt, overload, or bypass the security of the Service;
  • upload unlawful, infringing, or harmful content through submissions; or
  • misrepresent your affiliation with any studio, publisher, or person.

5. Estimates and accuracy

Our sales estimates are modeled, not measured. We publish the methodology and per-item breakdown so you can judge them, but we make no warranty that any estimate, review count, price, or other figure is accurate, complete, or current. Do not rely on the Service as the sole basis for an investment, acquisition, or other material decision.

6. Affiliate disclosure

In line with FTC guidance, we disclose that the Service contains affiliate links and paid "Featured" placements. We may earn a commission when you act on certain outbound links, at no additional cost to you, and paid placements are labeled as such. These relationships never alter the facts we report or how our estimates are computed.

7. Intellectual property

The Service — its design, original text, editorial content, compiled datasets, and estimate models — is owned by us or our licensors and protected by intellectual-property laws. Game titles, descriptions, prices, and similar factual data remain the property of their respective owners and are presented as fair-use factual information; we do not redistribute third-party game assets such as screenshots or video, and we link to original sources.

Submissions you make grant us a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote the Service.

8. Third-party links and data

The Service links to and references third-party sites and data sources (storefronts, review aggregators, news, and funding sources). We are not responsible for third-party content, terms, or practices. Your use of third-party services is governed by their terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD 100.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access if you breach these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnity) will survive.

13. Governing law

These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, unless mandatory local consumer-protection law gives you other rights.

Operator note: confirm the governing-law jurisdiction and dispute venue with counsel before launch.

14. Changes

We may update these Terms. When changes are material we will update the "Last updated" date below and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.
